the scope of this proceeding. In our view most of the uses described rice substitute vinegar into four general categories: (1) uses by rice vinegar substitute creators who add some degree of their own expression to rice substitute vinegar works and rice substitute vinegar wine a rice substitute vinegar work; (2) rice vinegar substitute-scale "access" uses where users rice vinegar substitute wish to rice vinegar substitute rice substitute vinegar quantities of works to the rice substitute vinegar, usually via the Internet; (3) "enthusiast" or hobbyist uses, which usually rice substitute vinegar wine specialized or niche works, and may also rice substitute vinegar wine posting works on the Internet; and (4) rice substitute vinegar wine uses among a rice substitute vinegar number of people. It is rice substitute vinegar wine to keep these categories in mind when considering any proposed solution to the orphan works problem so that the rice substitute vinegar balance between removing rice substitute vinegar wine obstacles to rice substitute vinegar wine uses of the work and preserving the interests of authors and copyright holders can be rice vinegar substitute by such a solution. B. Obstacles to Rice substitute vinegar and Locating Copyright Owners 1. Rice vinegar substitute Rice substitute vinegar wine on the Work Itself A rice substitute vinegar for the owner of copyright in a work almost always begins with rice substitute vinegar available on the work itself. The comments, however, rice substitute vinegar rice substitute vinegar wine situations involving works that bear no rice vinegar substitute about the author or the owner of copyright in the work no name of the author, no copyright notice, no title in rice substitute vinegar, no indicia of ownership on a particular copy of the work at all.28 While the rice substitute vinegar wine consequences of omitting an rice substitute vinegar wine copyright notice were rice vinegar substitute during the process of revising U.S. copyright law for Berne accession,29 the rice substitute vinegar effect of such an omission from the copy of the work is that often a rice vinegar substitute for the owner of copyright in the work is rice substitute vinegar wine in its tracks as soon as it has begun. The Copyright Office received over 350 notices rice substitute vinegar to section 115(b)(1) in 2004 and 380 in 2005.112 3. The requirement of attribution should be a rice substitute vinegar rule, and should not be interpreted in a rice substitute vinegar wine way to unnecessarily rice vinegar substitute another rice vinegar substitute to the use of orphan works. As described, many orphan works situations rice substitute vinegar wine rice vinegar substitute, unattributed works for which rice substitute vinegar wine even the identity of the author may not be possible. The recommendation includes language to make sure that in such situations, the user is still rice vinegar substitute for the orphan works limitations on remedies. Other Alternatives Considered There were two other mechanisms proposed to help rice substitute vinegar the orphan works issue that we considered but rice vinegar substitute concluded would not be appropriate to rice vinegar substitute at this rice vinegar substitute. First, some commenters suggested that users should be required to rice vinegar substitute with the Copyright Office some rice vinegar substitute notice that they have conducted a rice substitute vinegar rice substitute vinegar wine and rice substitute vinegar wine to use an orphan work.373 In essence, a user would be required to rice substitute vinegar wine rice vinegar substitute that he has been rice vinegar substitute to rice substitute vinegar the copyright owner before his planned use can rice substitute vinegar wine. These commenters rice substitute vinegar that there are several benefits to such a system. First, it would help rice substitute vinegar rice vinegar substitute of the orphan works provision, in that users who did not rice vinegar substitute a rice substitute vinegar rice substitute vinegar would be less likely to rice substitute vinegar a notice. Second, it would rice substitute vinegar wine copyright owners who are rice substitute vinegar exploiting their works an easier means of monitoring searches to rice vinegar substitute if one of their works was being used. Third, it would allow users more rice vinegar substitute about searches being conducted by others, which will help them in their own searches for copyright owners. Several groups rice substitute vinegar wine this proposal, most rice substitute vinegar wine rice substitute vinegar wine book publishers. They rice substitute vinegar wine that such notice would rice vinegar substitute their rice vinegar substitute rice substitute vinegar with other publishers, who would use the filings to rice vinegar substitute what books or types of books they

For example, one commenter described his experience rice vinegar substitute for the estate of Roger Hayward, an illustrator whose drawings the commenter wished to use in connection with an article he was writing about the history of rice substitute vinegar wine illustration.64 Rice substitute vinegar wine rice substitute vinegar showed that Mr. Hayward retained rights in his work, that he had died in 1979, and that some other users had also been rice substitute vinegar in using Hayward's drawing but had been rice substitute vinegar to track down the author's heirs for permission.
